The Sarawak Malay Court had handled family matters according to “Undang-undang Mahkamah Melayu Sarawak” 1915 (as amended in 1956), an earlier legislation containing several weakneses. In 1978, the Sarawak Shariah Court was established under “Undang-Undang (Pemerbadanan) Majlis Islam Sarawak”

On  March 1st  1985, “Undang-Undang Order” 1985 was enforced.  In their concern to uplift the position and dignity of Islam, the Sarawak Government separated the administration of the Shariah Courts from Majlis Islam Sarawak.

On October 2nd 1990, the Sarawak Syariah Judiciary Department was established. On May 14th 1991, the Sarawak’s Government approved the following  six statutes:

  • Ordinan Mahkamah Syariah
  • Ordinan Acara Jenayah
  • Ordinan Acara Mal
  • Ordinan Kesalahan Jenayah Syariah
  • Ordinan Undang-undang Keluarga Islam
  • Ordinan Undang-undang Keterangan Islam


On September 1st 1992, all the six statutes were gazetted and came into force. They were subsequently amended on December 27th 2001 and had been enforced since December 1st 2004.
